Right of withdrawal for consumers

(A consumer is any natural person who enters into a legal transaction for purposes that cannot be attributed primarily to their commercial or self-employed professional activities.)

Right of withdrawal

You have the right to cancel this contract within 14 days without giving any reason. The cancellation period is 14 days from the day,

  • at which point you or a third party designated by you, other than the carrier, took possession of the goods, provided that you ordered one or more items as part of a single order and that these were delivered in a single shipment;
  • as of the date on which you or a third party designated by you, other than the carrier, took possession of the last item, provided that you ordered multiple items as part of a single order and these items were delivered separately;
  • at the time when you or a third party designated by you, other than the carrier, took possession of the last partial shipment or item, if you ordered goods that were delivered in several partial shipments or items.

To exercise your right of withdrawal, you must notify us (ROC-Products GmbH, Hohe Bleichen 8, 20354 Hamburg, Germany, phone: +49 40 524797620, email: service@roc-products.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail, a fax, or an email). You may use the attached model withdrawal form, but this is not mandatory.

To comply with the withdrawal period, simply send notice of your intention to exercise your right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery method we offer), without delay and no later than 14 days from the date on which we received notification of your withdrawal from this contract. For this refund, we will use the same payment method you used for the initial transaction, unless otherwise expressly agreed with you; under no circumstances will this refund be made to you.

We may withhold the refund until we have received the goods or until you have provided proof that you have returned the goods, whichever comes first.

You must return or hand over the goods to us without delay and, in any event, no later than 14 days from the date on which you notified us of your withdrawal from this contract. The deadline is met if you ship the goods before the 14-day period expires.

You are responsible for the direct return shipping costs for goods that can be shipped as parcels, as well as the direct return shipping costs for goods that cannot be shipped as parcels. The costs for goods that cannot be shipped as parcels are estimated at a maximum of approximately 50 euros.

You are only liable for any loss in value of the goods if such loss is due to handling of the goods that is not necessary to ascertain their nature, characteristics, and functioning.

 

Grounds for exclusion or termination

The right of withdrawal does not apply to contracts:

  • relating to the delivery of goods that are not prefabricated and for the manufacture of which the consumer’s individual choice or decision is decisive, or that are clearly tailored to the consumer’s personal needs;
  • relating to the delivery of goods that can spoil quickly or whose expiration date would soon pass;
  • upon delivery of alcoholic beverages whose price was agreed upon at the time the contract was concluded, but which cannot be delivered until 30 days after the contract was concluded and whose current value depends on market fluctuations over which the contractor has no control;
  • for the delivery of newspapers, magazines, or illustrated periodicals, with the exception of subscription contracts.

The right of withdrawal expires early for contracts:

  • relating to the delivery of sealed goods that cannot be returned for health or hygiene reasons if their seal has been broken after delivery;
  • regarding the delivery of goods which, by their nature, have been inseparably mixed with other goods after delivery;
  • regarding the delivery of audio or video recordings or computer software in sealed packaging, if the seal has been broken after delivery.
